Master Terms of Service

"Sections 2 and 3 apply specifically to Rental and Sales transactions respectively. If your order contains both, both sections apply."

1. General Provisions (Applies to ALL Transactions)

• Verification: All customers must provide valid government-issued ID.

• Payments: We use secure third-party processors (Stripe/Square). We do not store your full credit card details.

• Privacy: We collect data to process your order and, for rentals, to monitor equipment via GPS. (See our full Privacy Policy at diydiggerdepot.com).

2. Rental-Specific Terms

• Equipment Status: Rentals are "As-Is" and must be returned in the same condition.

• Liability: The Renter is responsible for all damage to the equipment (excluding normal wear and tear) while in their possession. This includes tires, tracks, glass, and hydraulic hoses damaged by debris. Renter assumes all risk of operation. You are responsible for "Call Before You Dig" (811) requirements.

• Theft: In the event of theft, the Renter must provide a police report within 24 hours. Renter remains liable for the full replacement value of the equipment if it was left unsecured.

• Telematics: Rental units are equipped with GPS tracking. By renting, you consent to location monitoring for security and maintenance.

• The "Full-to-Full" Rule: Equipment is sent out with a full tank of fuel. If returned with less than a full tank, a refueling surcharge of $8 per gallon will apply.

• Cleaning Fees: Equipment must be returned reasonably clean. Machines returned with excessive mud, concrete splatter, or hazardous debris are subject to a professional detailing fee starting at $150.

• Daily Maintenance: For multi-day rentals, the Renter is responsible for daily fluid checks (oil, coolant, hydraulic fluid) and greasing as specified by the manufacturer.

3. Delivery & Late Returns

• Access: Renter must provide a clear, level, safe path for our delivery trucks. If we cannot safely drop off or pick up the unit, an additional "Dry Run" fee will be charged.

• Late Fees: Rental periods are strictly enforced. Equipment returned more than 2 hours late will trigger a "Full-Day" rate.

4. Sales-Specific Terms

• Title Transfer: Ownership and title to the equipment transfer to the Buyer only upon receipt of full payment and the clearing of all funds.

• Manufacturer’s Warranty: For New Equipment, the Manufacturer’s Warranty applies starting from the date of purchase. It is the Buyer’s responsibility to register the product with the manufacturer to activate coverage.

• Used "As-Is" Sales: Unless a manufacturer’s warranty applies or an optional dealer warranty is purchased in writing, all equipment is sold "As-Is, Where-Is" with all faults. RAD Power Equipment, LLC (d/b/a DIY Digger Depot) expressly disclaims any implied warranty of merchant-ability or fitness for a particular purpose.

• Optional Dealer Warranty: At its sole discretion, RAD Power Equipment, LLC (d/b/a DIY Digger Depot) may offer an Extended or Optional Dealer Warranty for purchase on select units. If purchased or expressly included, the specific terms, duration, and coverage of said dealer warranty will be provided in a separate written addendum at the time of sale.

• Inspection: Buyer acknowledges they have had a full opportunity to inspect and test the equipment prior to purchase. Following the transfer of title, all risk of loss or damage passes to the Buyer.

5. Safety, Liability, & Indemnification

• Assumption of Risk: Whether renting or purchasing, the User acknowledges that operating heavy machinery is inherently dangerous. The User and/or Operator assumes all risk of personal injury, death, and property damage. RAD Power Equipment, LLC (d/b/a DIY Digger Depot) is not liable for any injury, damage, or lost profits (including, but not limited to, project delays or business interruption) resulting from the use, operation, or mechanical failure of the equipment.

• Indemnification: The User/Renter agrees to defend, indemnify, and hold RAD Power Equipment, LLC (d/b/a DIY Digger Depot) harmless against any and all claims, lawsuits, legal costs, and liabilities—including third-party claims—arising out of or related to the User’s possession, maintenance, or operation of the machinery.

• Prohibited Use: Equipment shall not be used for any illegal purpose, operated by untrained or unauthorized individuals, or overloaded beyond the manufacturer's rated capacity. Rental equipment must remain at the agreed-upon job site address; removal of equipment from the site without express written consent from RAD Power Equipment, LLC (d/b/a DIY Digger Depot) is strictly prohibited and may be reported as theft.

• Safety Compliance: Proper operator training, the use of Personal Protective Equipment (PPE), and adherence to "Call Before You Dig" (811) requirements are the sole responsibility of the User.

Right to Modify Terms RAD Power Equipment, LLC (d/b/a DIY Digger Depot) reserves the right to modify, update, or replace these Master Terms of Service at any time. Any changes will be effective immediately upon posting to our website. Your continued use of our services or equipment following any changes constitutes acceptance of those updates. While we may attempt to provide courtesy notice for significant changes, it is the user’s responsibility to review the Master Terms periodically at diydiggerdepot.com.
